Benjamin M. Basista

Benjamin Basista focuses his legal practice in the area of Medicare compliance with an emphasis on the railroad industry.

Benjamin addresses Medicare issues that arise in the resolution of workers’ compensation, general liability and FELA claims. He is retained by a number of insurance carriers, third party administrators, and self-insured entities, including Class I and short line railroads, to advise them on compliance matters regarding the Medicare Secondary Payer Statute.

Benjamin frequently lecturers to insurance carriers, self-insured businesses, law firms and professional organizations on the topic of Medicare compliance. He has been named as industry Medicare advisor to the Association of American Railroads Medicare Compliance group and has assumed the role of legislative chair for the National Association of Medicare Set-Aside Professionals.

After graduating from law school, Benjamin served as a law clerk to the Hon. Paul F. Lutty in the Court of Common Pleas of Allegheny County and worked in the Pittsburgh office of the National Labor Relations Board.
