In an effort to keep you up-to-date on current trends with Medicare, the Burns White Medicare Attorney's are presenting the following information for your review and to also encourage the marketplace to take advantage of CMS' request to complete their survey. On July 17th, CMS posted the following announcement on its web site at http://www.cms.hhs.gov/WorkersCompAgencyServices/01_overview.asp, (found at first link above) that they have intentions, by calendar year 2010, to streamline the WCMSA proposal submission process with an internet web-based portal.

CMS believes the following efficiencies would be gained by this portal development:

1. Allows for quicker creation of new WCMSA cases for processing.
2. Facilitates tracking of the status of submitted WCMSA cases.
3. Provides for almost instantaneous feedback to the submitter.
4. Reduces the need for mailings.

While at face value, we believe that this is a positive development, we are still studying this proposal. In the meantime, we plan on providing our feedback to CMS via their "Survey of Workers' Compensation Medicare Set-Aside (WCMSA) Process" located at the following direct link:
http://www.cms.hhs.gov/WorkersCompAgencyServices/Downloads/WCMSAWebSurvey.pdf (survey found at second link above) and ask that the marketplace also participate in this survey so as to have your recommendations heard by CMS.

Completed survey responses are to be e-mailed (please include "Survey" in your subject line) to the MSP Central mailbox at: mspcentral@cms.hhs.gov by July 31, 2009.

We thank you for giving your attention to this matter. Please feel free to contact the Attorneys at Burns White with any questions you might have. Bruce McKnight will facilitate your questions. He can be reached at (412) 995-3247 or bemcknight@burnswhite.com.
