CMS Mandatory Reporting Alert

February 17, 2010 - The Centers for Medicare and Medicaid Services (CMS) have officially deferred the date for first production of Non-Group Health Plan (NGHP) Input Files from April 1, 2010 to January 1, 2011, effective immediately.

In the interim, CMS has announced that NGHP data exchange testing will continue during 2010 as needed. In addition, CMS has noted that all NGHP Responsible Reporting Entities (RREs) should be registered with the Coordination of Benefits Contractor and currently testing, or preparing for file testing status. The data exchange testing will be completed by December 31, 2010 for all NGHP files.

Additionally, CMS has stated that they will post the newest version of the “Section 111 NGHP User Guide” during the week of February 22, 2010, as well as several alerts relating to particular NGHP policy issues. As part of these alerts, CMS will be issuing guidance that NGHP RREs should take to assure their ongoing compliance with the Section 111 Reporting Requirements.
