Verdict Obtained under Contractor and Subcontractor's Payment Act


Burns, White & Hickton attorney John B. Cromer, representing Centimark Corporation, obtained a verdict for the full amount of a roofing contract that was never paid. After performing roofing services and invoicing the customer, the defendant refused to pay the bill claiming that the roof work was poorly done and that dangerous materials were used in repairing the roof. A collection suit commenced, and the defendant counterclaimed for an entire new roof. After a trial on the evidence, Centimark was awarded the full amount of the contract. The verdict was then molded to include attorneys fees, interest, penalties, expert fees, and costs pursuant to the Contractor and Subcontractor's Payment Act.
